Mairs and officers of the said Sheriffdom conjunctly and severally especially constitute greeting
Whereas it is humbly meant and shewn to me by my Lovite Ranald MacDonald of Ulva Esq’r
Heritable proprietor of the land and others aforementioned that by Act of Sederunt of the Lords
Of Council and session of date the fourteenth Decm’r Jan’y 8th fifty six anent removings it is inter
Alia provided & declared that it shall be lawful for the Heritor or other S [???] of the Lands in his
Option either to use the order presented by the Act of parliament 1555 entitled Act Ament the
Warning of tenants and thereupon pursue’t removing and ejection or to bring his action of
Removing against the tenant before the judge ordinary and such action being called before the
Judge ordinary at least forty days before the term of Whitsunday shall be held equal to a warnexe [?]
In terms of the foresaid Act and the judge shall thereupon proceed to determine in the removing in
Terms of this Act of Sederunt in the same manner as if a warning had been execute in terms of the
foresaid Act of Parliament And albeit the complainer has oft and divers times desired and
required Duncan McInnis Alexander Allan and Hector MacQuaries pretended tenants
and possessors of the lands of Cove or of some part or portion thereof

Item: Peggy McKinnon alias McLean widow, Duncan McDonald, John McKinnon, Neill
McKinnon and Hector McLean pretended tenant and possessor of the Lands of
Balemeanach or of some part or portion thereof [Balemeanach nr Gribun]
Item: Hector, John and Donald McKinnons and William McLeod pretended tenants and
possessors of the Lands of Inch Kenneth, or of some part of portion thereof;
all lying in the parishs of Kilninian and Kilfinichen and Sheriffdom aforesaid to flitt and
remove themselves, wives, bairns, families, servants, subtenants, cottars, dependers,
goods and gear forth and from their occupations and possession of the lands and other
above mentioned.
Yet they refuse to do so unless compelled as is alledged.
Wherefore in all Law Equity and Justice and in Terms of the aforesaid Act of Sedurunt
the said defenders aught and should be decerned and ordained by Decree of Court to flit
and remove themselves and their foresaids forth and from their occupations and
possessions of the houses, grass, pasturage of the said lands and pertinents thereof at
the term of Whitsunday (Old Style) next to come Eighteen hundred and five years; and
from the arable grounds thereof at the separation of the ensuing crop from the ground in
the said year and to desist and cease therefrom and leave the same void and redd it
against the said terms or at such other time or terms as may correspond with their entry
into possession to the effect the complainer or others in his name may then enter thereto
and set use and dispose thereof at pleasure conform to the Laws and daily practice of
Scotland used and observed in like cases in all points
HEREFORE IT IS MY WILL and I charge you strictly and command that ye lawfully
summon warn and charge the said defenders personally or at their respective dwelling
places to compear before me or my substitute in a Sheriff Court to be holden within the
ordinary court house at Tobermory the [space left blank] day of March current in the hour
of cause to answer at the instance of the said pursuer in the matters lybelled. That is to
say {or else} with --------[?] According to Justice the which to do under the subscription of
the clerk of court at Tobermory the 6th day of March 1805 years
